Terms of Service

Bogey Club is a social golf-pool game. You pick professional golfers and compete with friends on private leaderboards for fun and bragging rights.

Bogey Club does not collect, hold, process, transfer, or pay out any money in connection with pools. Any "entry fee," prize, or payout shown in the app is purely an optional bookkeeping convenience entered by a pool's commissioner. All such arrangements, if any, are made privately between members entirely outside the Service. Bogey Club is not a gambling, betting, wagering, fantasy-sports wagering, or money-transmission service, and we take no part in collecting or distributing funds. You are solely responsible for ensuring any private arrangements among your group comply with the laws that apply to you.

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements and that your use complies with all laws that apply to you.

• You sign in using your email and a one-time code. Keep access to your email secure — anyone with it may be able to access your account.
• You're responsible for the activity that happens under your account.
• The information you give us must be accurate and kept up to date.
• You can delete your account at any time from within the app (Settings). Deleting your account removes your personal information as described in our Privacy Policy.

You agree not to:

• Use the Service for any unlawful purpose, including unlawful gambling;
• Harass, abuse, impersonate, or harm other users;
• Post content that is illegal, offensive, infringing, or misleading;
• Attempt to disrupt, hack, reverse-engineer, or overload the Service;
• Use the Service to collect or distribute money in violation of these Terms or any law.

We may suspend or terminate accounts that violate these Terms.

• A "commissioner" creates a pool, sets its rules, invites members, and may be required to confirm members before they can submit picks.
• Picks can be edited up until each pool's deadline, after which they lock.
• Leaderboards and scoring are provided for entertainment and may rely on third-party golf data that can be delayed, incomplete, or inaccurate. We don't guarantee the accuracy of scores, standings, or results.
• As noted in Section 1, any entry-fee or payout figures are informational only and are not handled by Bogey Club.

• Bogey Club Pro is an optional auto-renewing subscription that unlocks additional features. Pricing is shown in the app before you purchase.
• Billing. Payment is charged to your Apple account at confirmation of purchase. Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Managing and canceling. You can manage or cancel your subscription anytime in your device's App Store account settings. Cancellation takes effect at the end of the current billing period.
• Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly.

The Service, including its name, logo, characters, design, and content (other than your own content), is owned by Bogey Club or its licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service without our permission.

You retain ownership of the content you submit (such as your screen name and profile details). By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to use, host, and display that content as needed to operate the Service. You're responsible for the content you submit and confirm you have the right to share it.

The Service relies on third parties (for example, Apple, Supabase, RevenueCat, Expo, and golf-data providers). We're not responsible for the practices or availability of those third parties, and your use of them may be subject to their own terms.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that scores and standings will be accurate.

To the fullest extent permitted by law, Bogey Club and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the past 12 months or USD $50.

Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Bogey Club from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or the law — including any private money arrangements you make with other members.

You can stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. If a dispute arises, you agree to first try to resolve it informally by contacting us. Any dispute that can't be resolved informally will be handled exclusively by the state or federal courts located in Georgia, and you consent to their jurisdiction.

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
